         ด้วยประกาศกระทรวงสาธารณสุขว่าด้วยแยม เยลลี่ และมาร์มาเลดในภาชนะบรรจุที่ปิดสนิท มีผลบังคับใช้มาเป็นระยะเวลานาน นับแต่ปี พ.ศ. 2543 ดังนั้น เพื่อให้มีความเหมาะสมและสอดคล้องกับมาตรฐานอาหารสากล แต่ยังคงบนพื้นฐานการคุ้มครองผู้บริโภคให้ได้รับผลิตภัณฑ์อาหารที่ปลอดภัย มีคุณภาพ และสมประโยชน์ ขณะเดียวกันก็เป็นการสนับสนุนให้ผู้ประกอบการสามารถดำเนินธุรกิจได้อย่างมีประสิทธิภาพภายใต้กฎระเบียบที่มีความชัดเจนและทันสมัย กระทรวงสาธารณสุข โดยสำนักงานคณะกรรมการอาหารและยา จึงได้จัดทำประกาศกระทรวงสาธารณสุข (ฉบับที่ 455) พ.ศ. 2568 ออกตามความในพระราชบัญญัติอาหาร พ.ศ. 2522 เรื่อง แยม เยลลี่ และมาร์มาเลด ลงวันที่ 14 กุมภาพันธ์ พ.ศ. 2568 โดยกำหนดคุณภาพหรือมาตรฐานของแยม เยลลี่ และมาร์มาเลด ให้สอดคล้องกับมาตรฐานอาหารสากล ได้แก่ Codex Standard for Jams, Jellies and Marmalades (Codex STAN CXS 296-2009 (Amended in 2020) ซึ่งมีสาระสำคัญโดยสรุป ดังนี้

1. กำหนดสถานะการควบคุมแยม เยลลี่ และมาร์มาเลด ให้เป็นอาหารที่กำหนดคุณภาพหรือมาตรฐาน โดยการดำเนินการขออนุญาตผลิตภัณฑ์ดังกล่าวต้องปฏิบัติตามระเบียบสำนักงานคณะกรรมการอาหารและยาว่าด้วยการดำเนินการเกี่ยวกับเลขสารบบอาหาร

2.  กำหนดนิยามและขอบข่าย ดังนี้
         “แยม” (Jam) หมายความว่า ผลิตภัณฑ์ที่มีลักษณะข้นเหนียวพอเหมาะสำหรับใช้ทา ทำจากผลไม้หนึ่งชนิดหรือมากกว่า ซึ่งอาจเป็นผลไม้ทั้งผล ชิ้นผลไม้ ผลไม้บด หรือผลไม้บดละเอียด ทั้งนี้ อาจผสมน้ำผลไม้ อาหารที่มีคุณสมบัติให้ความหวาน หรือน้ำ ด้วยหรือไม่ก็ได้

         “เยลลี่” (Jelly) หมายความว่า ผลิตภัณฑ์ที่มีลักษณะข้นเหนียวเป็นเจลกึ่งแข็ง ใสหรือโปร่งแสง เหมาะสำหรับใช้ทา ทำจากน้ำผลไม้ หรือของเหลวที่ได้จากการสกัดผลไม้ด้วยน้ำ หนึ่งชนิดหรือมากกว่า ทั้งนี้ อาจผสมอาหารที่มีคุณสมบัติให้ความหวาน หรือน้ำ ด้วยหรือไม่ก็ได้

         “มาร์มาเลด” (Marmalade) หมายความว่า ผลิตภัณฑ์ดังนี้

(ก) “มาร์มาเลดที่ทำจากผลไม้สกุลส้ม” (Citrus Marmalade) หมายความว่า ผลิตภัณฑ์ที่มีลักษณะข้นเหนียวพอเหมาะสำหรับใช้ทา ทำจากผลไม้สกุลส้ม (Citrus) ชนิดเดียวกันหรือต่างชนิดผสมกัน ซึ่งอาจเป็นผลไม้ทั้งผล ชิ้นผลไม้ ที่ปอกเปลือกออกทั้งหมดหรือบางส่วน ผลไม้บด ผลไม้บดละเอียด น้ำผลไม้ หรือของเหลวที่ได้จากการสกัดผลไม้ด้วยน้ำ และนำมาผสมกับผิวผลไม้สกุลส้ม ทั้งนี้ อาจผสมอาหารที่มีคุณสมบัติให้ความหวาน หรือน้ำ ด้วยหรือไม่ก็ได้
(ข) “มาร์มาเลดที่ไม่ได้ทำจากผลไม้สกุลส้ม” (Non-Citrus Marmalade) หมายความว่า ผลิตภัณฑ์ที่มีลักษณะกึ่งเหลว ข้นพอเหมาะสำหรับใช้ทา ทำจากผลไม้หนึ่งชนิดหรือมากกว่า ซึ่งอาจเป็นผลไม้ทั้งผล ชิ้นผลไม้ ผลไม้บด หรือผลไม้บดละเอียด ทั้งนี้ อาจผสมน้ำผลไม้ อาหารที่มีคุณสมบัติให้ความหวาน หรือน้ำ ด้วยหรือไม่ก็ได้

(ค) “เยลลี่มาร์มาเลด” (Jelly Marmalade) หมายความว่า ผลิตภัณฑ์ที่มีลักษณะข้นเหนียวเป็นเจลกึ่งแข็ง ใสหรือโปร่งแสง เหมาะสำหรับใช้ทา ทำจากน้ำผลไม้สกุลส้ม (Citrus) ชนิดเดียวกันหรือต่างชนิดผสมกัน แต่อาจมีเปลือกของผลไม้สกุลส้มหั่นเป็นชิ้นบางๆ ผสมอยู่ด้วย ทั้งนี้ อาจผสมอาหารที่มีคุณสมบัติให้ความหวาน หรือน้ำ ด้วยหรือไม่ก็ได้

         Since the Notification of the Ministry of Public Health, Re: Jam, jelly, and marmalade in sealed containers has been in force since B.E. 2543 (2000), it has become necessary to revise it to ensure appropriateness and alignment with international food standards, while upholding the fundamental principle of consumer protection to ensure that consumers receive food products that are safe, of good quality, and wholesome.

         At the same time, this revision aims to support business operators in efficiently conducting their activities under clear and up-to-date regulations. Therefore, the Ministry of Public Health, through the Food and Drug Administration (FDA), has issued the Notification of the Ministry of Public Health (No. 455) B.E. 2568 (2025), issued by virtue of the Food Act B.E. 2522 (1979) regarding Jams, Jellies, and Marmalades, dated February 14, B.E. 2568 (2025).

         This Notification prescribes the quality and standards for jams, jellies, and marmalades in accordance with international food standards, specifically the Codex Standard for Jams, Jellies and Marmalades (Codex STAN CXS 296-2009, amended in 2020). The key points of the Notification are summarized as follows:

1. Jams, jellies, and marmalades are prescribed as foods to have qualities and standards. Any application for approval of said products shall comply with the regulations of the Food and Drugs Administration regarding food serial numbers.

2. Definitions and scopes of terms are prescribed as follows:
         “Jam” means a product with a suitable consistency for spreading, made from one or more kinds of fruit, which may be whole, in pieces, fruit pulp or fruit puree, with or without the fruit juice, foodstuffs with sweetening properties, or water.

         “Jelly” means a product with a semi-solid, gelled consistency that is clear or translucent and suitable for spreading. It is made from fruit juice or aqueous extracts of one or more fruits, with or without the foodstuffs with sweetening properties, or with water.

         “Marmalade” means the following products:

(a) “Citrus Marmalade” means a product with a suitable consistency for spreading, made from one or more kinds of citrus fruits (Citrus). It may be made from whole fruit, fruit pieces which may have all or part of the peel removed, fruit pulp, fruit puree, fruit juice, or aqueous extracts, and mixed with citrus peel, foodstuffs with sweetening properties with or without the addition of water.

(b) “Non-Citrus Marmalade” means a product with a semi-liquid, suitable consistency for spreading, made from one or more kinds of fruit, which may be whole, in pieces, fruit pulp, or fruit puree. fruit juice, foodstuffs with sweetening properties, with or without the addition of water.

(c) “Jelly Marmalade” means a product brought to a semi-solid gelled consistency that is clear or translucent and suitable for spreading, made from the juice of one or more citrus fruits, and which may mix thin slices of citrus peel, foodstuffs with sweetening properties, with or without the addition of water.
